I'm in a band and have heard of Lustra(not my fav band..lol)..her creative people just should have asked the band if they could use it as a cover..not just take it and pass it off as something they wrote for miley..lustra probably would have been flattered..not felt like they got ripped off..you have all these non musicians sampling from other artists works and most bands don't mind(remember run dmc's version of areosmith's walk this way?) there's nothing wrong with doing a cover song, but her people should have asked to use it and also not just give all the credit on the song to her songwriters and miley for composing the song

If your in a band then you should clearly know that hearing similar or the same riffs come and go.

This is not plagiarism, please i've heard worse rip offs than this. Let the girl be.

ok honestly i dont think its miley's fault because she didnt write the song but being a student of music and having an ear for it i have listened to both songs and while the similarities do not last throughout, the opening riff of miley's song is definitely a variation of Lustra's song and if you really want proof learn the words to one of the songs and sing them to the other it fits pretty easily once again i dont blame miley i blame the songwriters

Miley cyrus is just a target from every band every singer every actress and pretty much anyone that doesnt like her first those pictures were works of art and she is lucky to be photographed by the photogrpher in the first place its not like she belongs to a stripclub because people say she might as well have when far from it! now this! these songs are NOTHING ALIKE get a break! coincidence if anything i hear no similarities at all if there is any oh well they made a mistake give the girl a break she's not the one playing the song she sings it ! everyone that targets her is mainly jealous of her because she is famous so young and very popular

she is young i do agree but we dont live in simple times anymore where the youth is held ignorant and innocent. Besides miley did nothing illegal with those pictures. She was covered none the less.

WHAT "MISTAKE" IS MADE WHEN YOU ARE PHOTOGRAPHED LOOKING LIKE A GORGEOUS YOUNG GIRL, I think you are a perv how old is she?? i know my child isn't allowed to watch her anymore or have anything to do with her and her products after the nasty pictures. My 7 yr old isn't allowed to dress nor act like the girls of today. Atleast not in that manner

Well, first of all, I don't think the two songs sound that much alike.
And if the song was "stolen", it obviously wasn't by Miley Cyrus herself ... since she just sings the songs and doesn't write them. So, how can she be to blame?
Besides, why would she be stealing such a crappy song anyways? :-)

I DON'T THINK MILEY HAS ANYTHING TO APOLIGIZE FOR. WHAT 'TWO MISTAKES", IS SHE SUPPOSED TO HAVE MADE? IT ISN'T A "MISTAKE" TO SING A SONG THAT WAS WRITTEN FOR YOU AND THAT WASN'T STOLEN. IF A FEW NOTES ARE "SIMILAR", IT DOESN'T MEAN THEY WERE "STOLEN", IT JUST MEANS THEY FIT HER LYRICS AND HER VOICE RANGE. TO COMMIT A "CRIME" THERE HAS TO BE "INTENT". THE PICTURES ARE BEAUTIFUL. SHE WAS FULLY CLOTHED BOTH UNDER THE WRAP AND WITH THE WRAP. SHE COULD JUST AS WELL HAVE BEEN AT THE BEACH UNDER A BEACH TOWEL. I SEE, NOR HEAR, ANY "EVIDENCE" THAT ANYTHING WAS "STOLEN". THERE ARE MORE SIMILARITIES IN THOUSANDS OF SONGS, THAN THERE ARE IN THESE TWO PIECES OF MUSIC. COUNTRY MUSIC, IN PARTICULAR, AND POP AS WELL, ALL HAVE SOUNDS WHICH ARE VERY MUCH ALIKE OR HAVE SECTIONS USING MANY OF THE SAME NOTES. WITH THIS TYPE OF MUSIC, THERE IS A LIMITED RANGE OF NOTES AND SOUNDS WHICH ANY GIVEN SINGER CAN SING. I THINK IT IS STUPID TO GIVE SO MUCH CREDENCE TO A PERSON CLAIMING THAT HIS MUSIC WAS STOLEN WITHOUT ACTUALLY LISTENING TO IT FOR YOURSELVES. IT'S HOGWASH.
